Geneoscopy: SMS Terms and Conditions Statement
- By opting into the ColoSense® text message program, you consent to receive text messages from Geneoscopy. The text messages will be non-marketing and may include notifications and updates about your ColoSense test order. Notice under HIPAA: Please note that by providing your mobile phone number, you acknowledge that messages from the ColoSense text message program, which may include some limited protected health information, will be sent to the number you provide. This information may be viewed by whoever has access to that mobile phone or the carrier account. Messages sent as part of the ColoSense text message program are unencrypted. Unencrypted messages may be intercepted or received by unintended third parties and stored or archived by service providers and system operators.
- If you would like to stop receiving text messages, text “STOP” or contact us at 1-800-305-8299. Please note that opting out of text messages will only opt you out of the ColoSense text message program; you will remain opted into any other Geneoscopy text message program(s) to which you may be separately opted in. After receiving your “STOP” text message, we may send you a text to confirm that you have opted out of the text message program. You will no longer receive text messages regarding ColoSense after this confirmation. You may rejoin the ColoSense® text message program by signing up again at any time.
- By opting into the ColoSense® text message program, you represent that you are the account holder for the mobile telephone number(s) that you provide to opt into the texting program. You are responsible for notifying Geneoscopy immediately if you change your mobile telephone number. You may notify Geneoscopy of a number change by contacting the Geneoscopy Customer Support Center at 1-800-305-8299.

- Message and data rates may apply to each text message sent or received in the ColoSense® text message program, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans) and any applicable roaming charges. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Geneoscopy does not impose a separate fee for sending text messages.
- Data obtained from you in connection with this Short Message Service (SMS) texting program may include your telephone number, your carrier’s name, and the date, time, and content of your messages. Geneoscopy may use this information to contact you and provide the services you request from us, and as described in our corporate Privacy Policy and Notice of Privacy Practices Under HIPAA which is incorporated by reference into these Terms.
- Geneoscopy will not be liable for any delays in receiving text messages, as delivery is subject to effective transmission from your network provider.
- You agree to defend, indemnify and save harmless Geneoscopy and parties texting on its behalf in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify us if you change your telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
- Geneoscopy may suspend or terminate your receipt of text messages if it believes you are in breach of these SMS Terms and Conditions. Your receipt of text messages is also subject to termination if your mobile telephone service terminates or lapses. Geneoscopy reserves the right to modify or discontinue, temporarily or permanently, all or any part of the text messaging services you receive, with or without notice.
- Geneoscopy may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect upon posting to our website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive text messages will indicate your acceptance of any changes.
